"We know transition from dictatorship to democracy, from terror to the rule of law, does not happen overnight. It has to be built step by step. Some of the steps are painful and difficult, but Libya is entitled to expect the support of the international community to that end. That support includes the significant role judges of this Court can play in helping Libya achieve that goal."

"We believe that the Libyan evidence is as comprehensive if not more so, significantly more so than that which has been gathered to date by the ICC prosecutors office. Moreover, any Libyan proceedings against Mr. Qadhafi would also include other conduct which is outside the scope of the charges presently envisaged by the ICC prosecutor."

STORYLINE:

Libya's Representative before the International Criminal Court (ICC), Ahmed El-Gehani, told the Court that not granting Libya the necessary time to prepare a case against Saif al-Islam al-Qadhafi "would be contrary to the necessity to cooperate with a post-conflict Government facing serious security problems."

The Libyan Government argues that it should be allowed to prosecute Qadhafi for crimes against humanity, while his defence claims that he will not receive a fair trial in Tripoli and should be tried in The Hague.

Philippe Sands, Lead Counsel for the Libyan Government at the ICC said that "transition from dictatorship to democracy, from terror to the rule of law, does not happen overnight" but "Libya is entitled to expect the support of the international community to that end."

Sands said the Libyan evidence is as comprehensive if not "significantly more so than that which has been gathered to date by the ICC prosecutor's office."

He added that "any Libyan proceedings against Mr. Qadhafi would also include other conduct which is outside the scope of the charges presently envisaged by the ICC prosecutor."

The principle of complementarity of the ICC states that the Court can only try cases when nations are unable or unwilling to conduct their own trials.

On 27 June 2011, the ICC issued three warrants of arrest respectively for Muammar Mohammed Abu Minyar Gaddafi, Saif Al-Islam Gaddafi and Abdullah Al-Senussi for crimes against humanity (murder and persecution) allegedly committed across Libya from 15 until at least 28 February 2011, through the State apparatus and Security Forces.

On 22 November 2011, Pre-Trial Chamber I formally terminated the case against Muammar Gaddafi due to his death.
