No peace without justice

The announcement by the Prosecutor of the International Criminal Court that he is requesting the indictment of the President of Sudan for genocide, coming on the eve of the 10th anniversary of the creation of the Court, has raised the issue of whether the pursuit of justice might impede the cause of peace.

Sudan refuses to recognize the authority of the ICC, to which it is not a party.

The African Union, which has peacekeepers in Darfur in a joint mission with the United Nations, has asked the Security Council to postpone the indictment, while it attempts to negotiate peace in Darfur.

The Council itself, which charged the Prosecutor with investigating the crimes in Darfur, is divided on how to proceed regarding the indictment. The United Nations has made it clear that justice must not be subordinated to peace. Advocates for the victims in Darfur also say there is no peace without justice.
